Growth School — Terms and Conditions

Please read this User Agreement (“Agreement”) carefully before accessing or participating in any program, mailing, website, forums, transaction or other online resource available at www.growthschool.biz. By using these resources, you confirm that you have read the Agreement and agree to comply with it.

To provide services in Ukraine, Growth School operates as a sole proprietor — Andronikova Olena Oleksandrivna, registered on June 21, 2024 with the State Registration Service of Ukraine. For services in other countries, Growth School will notify users separately.

Online Conduct Rules

You agree to use the site in accordance with applicable law and not to post the following:

Content that defames or threatens others
Materials discussing illegal activities with intent to commit them
Content that infringes the intellectual property of others
Obscene (pornographic) materials
Advertising or any form of commercial solicitation
Any other unlawful content

You also agree not to attempt to access other users’ accounts or impersonate another person.

Permission to Use Materials

Growth School grants you a personal, non-exclusive, non-transferable license to access and use the sites. You may download materials solely for your own personal, non-commercial use. Copying, reproduction, transmission or commercial use of materials without permission is prohibited.

1 General Terms of Service

The subject of this Agreement is the provision of services, including:

Sessions, webinars, seminars, courses, workshops and other events — online and offline (“programs”)
Access to video recordings of programs, which are treated as separate services

Changes to schedules or programs are at the sole discretion of Growth School, including cancellation without explanation — provided users are properly notified.

2 Service Delivery Process

Growth School may engage third parties — speakers or authors — to assist in delivering services. Services are provided:

On the event date specified on the website or communicated directly
Video recordings and materials — within three business days after payment

Users are prohibited from sharing access to video recordings with third parties. Violation of this clause may result in termination of access and deletion of the user’s personal account.

3 Service Cost and Payment

The cost of services is determined by the price of each specific service published on the website, in the personal account or sent by email. Services are provided only upon full (100%) payment.

Users residing outside Ukraine must pay for services in foreign currency at the price listed on the relevant page of the website.

Refunds for paid but undelivered services are issued upon individual request sent to Growth School’s email. Refunds will not be provided for services that were delivered but not used for reasons beyond Growth School’s control — instead, the user will receive a video recording or other materials.

If a refund involves an international SWIFT transfer, any bank fees or payment system commissions will be deducted from the refund amount.

Personal Account

You are responsible for maintaining the confidentiality of your account and password. Your personal account contains information about ordered and received services, schedules, programs, prices and dates of future services.

The user is identified as the person whose email address is registered in the personal account.

Personal Data Collection, Storage and Processing

Data controller — sole proprietor Andronikova Olena Oleksandrivna, registered and operating under the laws of Ukraine.

Growth School collects and processes the following personal data:

Name, surname and address — to identify the user during registration, grant access and issue certificates
At the user’s discretion: phone numbers and social media contacts — to receive notifications
Email address — to receive information about programs

Growth School retains personal data for as long as necessary to fulfil its obligations. You may withdraw your consent to data processing by sending a request to growthschool.biz@gmail.com.

Under the Tax Code of Ukraine, certain data is retained in accounting records for at least three years and cannot be deleted at the user’s request before the end of this period.

Governing Law and Jurisdiction

The sites are hosted on computing resources located in Kyiv, Ukraine. You agree that any dispute arising from this Agreement is governed by the laws of Ukraine.

Disclaimer of Warranties and Limitation of Liability

The sites and any information, products or services on them are provided “as is” without any warranties. Growth School shall not be liable for any direct or indirect damages arising from the use or inability to use the sites.

Trademarks and Copyright

The logo, name and all graphic elements on Growth School’s sites are trademarks of Growth School or its affiliates. Use, reproduction or copying of trademarks without written permission from Growth School is prohibited.

General Provisions

This Agreement constitutes the entire agreement between you and Growth School with respect to the subject matter herein and supersedes any prior oral or written agreements.

Communication in chat groups with the administration or trainers has no legal consequences and cannot be considered official correspondence under this Agreement.

Growth School reserves the right to modify this Agreement at any time. By continuing to use the site after changes are published, you agree to be bound by them.
